If your business employs staff, you'll need to make sure you comply with the relevant HMRC rules. Getting to grips with the complexities of those rules can divert precious time and resources away from the running of your business.

What are my responsibilities?

Your employer law responsibilities are big enough to begin with. If you employ just one person, you'll need a PAYE scheme. And every time you pay an employee, you'll have to report it to HMRC via the real-time information (RTI) process. 

So what do you actually need to report?

  • When and how much you are paying an employee
  • What deductions you have made (e.g. tax, national insurance, student loan)
  • Recoverable CIS deductions
  • When an employee starts/leaves
  • The PAYE/NICs due to be paid over to HMRC by the 19th of the following month.
  • Taxable benefits in kind.

The aim of auto-enrolment couldn't be simpler: every single employer has an obligation to enrol eligible workers into a workplace pension scheme to which both employee and employer contribute. Each employer has their own “staging date” by when the scheme should be established, and if you miss it, you could face a penalty.

We can help you manage your requirements by:

  • determining and scheduling your obligations
  • liaising with the Pensions Regulator as required
  • introducing independent pensions advisors to set up and manage the scheme
  • introducing approved payroll agencies if required.

Tax for subcontractors

If you engage subcontractors, it is your responsibility to ensure that this status is appropriate so that they are taxed correctly on their earnings. This includes identifying any workers who might be caught by IR35. We can also help you if your business operates in the construction industry as you'll need to comply with a unique - and complex - set of identification rules and reporting procedures.
